1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Aicreatify ("we," "us," or "our"). By accessing or using the Aicreatify website, platform, API, or any related services (collectively, the "Service"), you agree to be bound by these Terms.

  • If you do not agree with any part of these Terms, you must immediately discontinue use of the Service
  • These Terms apply to all visitors, users, and others who access or use the Service, whether as a Guest, Free, or Paid user ("Users")
  • We reserve the right to refuse service to anyone for any reason at any time

2. Eligibility & Account Registration

To use certain features of the Service, you must register for an account. When registering, you agree to the following:

Eligibility Requirements

  • You must be at least 16 years of age to use the Service
  • You must have the legal capacity to enter into a binding agreement
  • If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms

Account Responsibilities

  • You must provide accurate, current, and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account at support@aicreatify.io
  • We reserve the right to suspend or terminate accounts that violate these Terms

3. Service Description & Usage Tiers

Aicreatify provides an AI-powered content creation platform for social media professionals, creators, and businesses. The Service is offered in the following tiers:

Guest Users (No Account)

  • Limited to 2 generations per tool (LinkedIn hooks, Instagram captions, hashtag sets)
  • No account registration required
  • Usage tracked locally in your browser
  • After reaching the guest limit, you will be prompted to view our pricing plans

Free Registered Users

  • 10 generations per tool per month (LinkedIn hooks, Instagram captions, hashtag sets)
  • Usage resets automatically at the beginning of each calendar month
  • Tracked by user account (email address)
  • Access to basic content templates and community support

Paid Users (Pro & Growth Plans)

  • Unlimited or high-quota content generation based on the selected plan
  • Access to advanced features including analytics, brand voice AI, content calendar, and multi-platform support
  • Priority or dedicated support depending on the plan
  • Additional features as described on our Pricing page

4. Intellectual Property Rights

Understanding who owns what when using Aicreatify:

Our Intellectual Property

  • The Service, including all source code, databases, designs, text, graphics, logos, and trademarks, is owned by or licensed to Aicreatify
  • The Service is protected by copyright, trademark, and other intellectual property laws
  • You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent
  • The Aicreatify name, logo, and all related names, logos, and slogans are our trademarks

Your Content & Generated Output

  • You retain ownership of all content you input into the Service (topics, keywords, preferences)
  • AI-generated content (hooks, captions, hashtag sets) created through the Service is yours to use for personal and commercial purposes
  • We do not claim ownership of AI-generated output produced for you
  • You are solely responsible for how you use, publish, or distribute AI-generated content
  • We may use anonymized, aggregated data to improve our AI models and Service quality

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities when using the Service:

Strictly Prohibited

  • Abuse & Fraud — Using the Service for any illegal, fraudulent, or unauthorized purpose
  • Reverse Engineering — Attempting to decompile, disassemble, reverse engineer, or extract the source code of the Service or its AI models
  • Circumvention — Bypassing usage limits, rate limits, or any security measures through technical manipulation
  • Scraping & Automation — Using bots, scrapers, or automated tools to access the Service without our written permission
  • Harmful Content — Generating content that is defamatory, obscene, harassing, threatening, or promotes violence or discrimination
  • Impersonation — Misrepresenting your identity, creating fake accounts, or impersonating others
  • Interference — Interfering with or disrupting the integrity or performance of the Service or its servers
  • Spam & Abuse — Using the Service to generate spam, phishing content, or misleading material
  • Reselling — Reselling or redistributing the Service or access to it without our authorization
  • Data Mining — Systematically extracting data from the Service for use in competing products or services

6. Payments, Billing & Refunds

If you subscribe to a paid plan, the following terms apply to payments and billing:

Billing Terms

  • Paid plans are billed on a monthly or annual basis as selected at checkout
  • All fees are quoted in USD and are exclusive of applicable taxes
  • Payment is processed securely through our third-party payment processor (e.g., Stripe)
  • You authorize us to charge your payment method for recurring subscription fees
  • We may change our pricing at any time, but changes will not affect your current billing cycle

Cancellation & Refunds

  • You may cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of your current billing period — you retain access until then
  • No prorated refunds are provided for partial months or unused portions of your subscription
  • We may offer refunds at our sole discretion in exceptional circumstances
  • If we terminate your account due to a Terms violation, no refund will be issued

7. Disclaimers & Limitation of Liability

Important legal disclaimers regarding your use of the Service:

  • The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind
  • We do not guarantee that the Service will be uninterrupted, secure, or error-free
  • AI-generated content is created by machine learning models and may contain inaccuracies, biases, or factual errors
  • You are solely responsible for reviewing, editing, and verifying all AI-generated content before publishing or using it
  • We do not guarantee any specific results, engagement metrics, or business outcomes from using the Service
  • We are not responsible for any consequences resulting from your use or publication of AI-generated content

Limitation of Liability

  • To the maximum extent permitted by law, Aicreatify shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise)
  • Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of these exclusions may not apply to you

You agree to defend, indemnify, and hold harmless Aicreatify and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

11. Governing Law & Dispute Resolution

These Terms are governed by applicable law, and disputes are resolved as follows:

Legal Framework

  • These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles
  • Any disputes arising from these Terms shall first be resolved through good-faith negotiation
  • If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules
  • You agree to waive any right to a jury trial or to participate in a class action
  • Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction

12. Termination

Either party may terminate this agreement under the following circumstances:

  • You may terminate your account at any time by contacting us or through your account settings
  • We may suspend or terminate your account immediately if you violate these Terms
  • We may terminate accounts that remain inactive for an extended period (12+ months)
  • Upon termination, your right to use the Service ceases immediately
  • We may retain certain data as required by law or for legitimate business purposes (see Privacy Policy)
  • Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination
